Digital signage firm sues tech provider over temperature-monitoring claims

SpinTouch, an Irvine, California-based company in the interactive digital signage industry, has sued Outform Inc., a Miami-based retail technology provider, and its CEO Ariel Haroush, for making false claims about the capabilities of a temperature-monitoring kiosk in an effort to profit from the coronavirus pandemic.

The suit, filed in California Central District Court, has been assigned to Judge David Carter.

Outform marketed the kiosk to employers, schools and businesses, claiming the product would accurately measure body temperature so people with a fever would not enter a school or a place of employment, the lawsuit states.

The suit claims Oxform's core component was a sensor made by Heimann Sensor SGbH. The sensor, however, was not made by Heimann and included a product that was not capable of accurately measuring body temperature, according to the suit.

The suit lists a number of product specifications advertised that turned out to be allegedly false. It also lists a number of problems with the unit that it ordered from Outform.

The suit further claims that a number of clients complained about the product's accuracy.

SpinTouch is seeking relief for general and specific damages, restitution and disgorgement of all profits Outform obtained from SpinTouch as a result of fraudulent business practices, punitive damages and costgs of suit.

Calls to Outform and its attorneys were not returned at the time of this report.
